These Terms of Use (“Terms”) govern your access to and use of (a) the website located at www.jasminejonte.com and any related subdomains (collectively, the “Site”), and (b) any content, features, tools, portals, communications, or online services made available through the Site (collectively, the “Services”). The Site and Services are owned and operated by The Alliance Mastermind, LLC, an Arizona limited liability company doing business as CRE8TION (“Cre8tion,” “we,” “us,” or “our”).
BY ACCESSING OR USING THE SITE OR SERVICES, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS. If you do not agree, you may not access or use the Site or Services.
Scope of These Terms
These Terms apply to all visitors, users, and others who access or use the Site or Services, including prospective clients, clients, collaborators, and contributors. Certain services offered by Cre8tion may be governed by a separate written agreement, including a master services agreement, statement of work, order form, or engagement agreement (each, an “Order”). In the event of a conflict, the applicable Order controls solely with respect to the services covered by that Order.
No Professional Advice
Cre8tion provides creative, technical, strategic, and production services related to course creation, digital education products, and related marketing infrastructure. Cre8tion does not provide legal, tax, financial, medical, mental health, or other regulated professional advice. You are solely responsible for consulting your own licensed professionals regarding compliance, disclosures, claims, and suitability of any content you publish or sell.
Eligibility
You must be at least eighteen (18) years old, or the age of majority in your jurisdiction, to use the Site or Services. By using the Site or Services, you represent and warrant that you meet this requirement and have the legal capacity to enter into a binding agreement.
Changes to the Site and Terms
Cre8tion may modify, update, suspend, or discontinue the Site, Services, or these Terms at any time. Changes become effective upon posting. Continued use of the Site or Services after changes are posted constitutes acceptance of the revised Terms.
Accounts and Security
If access to any portion of the Services requires an account:
- You agree to provide accurate, current, and complete information.
- You are responsible for maintaining the confidentiality of your login credentials.
- You are fully responsible for all activity occurring under your account.
- You must notify Cre8tion immediately of any unauthorized use or security breach.

Acceptable Use
You agree not to:
- Use the Site or Services for any unlawful, deceptive, or fraudulent purpose.
- Violate any applicable federal, state, or local law or regulation.
- Interfere with or disrupt the operation or security of the Site or Services.
- Attempt unauthorized access to systems, data, or networks.
- Upload or transmit malicious code, spyware, or harmful technology.
- Scrape, harvest, or extract data without authorization.
- Post or submit false, misleading, or fabricated reviews, testimonials, or endorsements.
- Suppress, retaliate against, or penalize users for submitting honest reviews.
Cre8tion reserves the right to investigate violations and take appropriate action, including suspension or termination of access.
User Content
“User Content” means any content you submit, upload, transmit, or make available through the Site or Services, including comments, testimonials, reviews, feedback, media, or communications.
By submitting User Content, you represent and warrant that:
- The content is truthful and not misleading.
- You own or have the necessary rights and permissions to submit it.
- It does not infringe intellectual property, privacy, or publicity rights.
- Any testimonials, endorsements, or results statements are genuine and compliant with applicable advertising laws and disclosure requirements.
You grant Cre8tion a nonexclusive, worldwide, royalty-free license to use, reproduce, display, and distribute User Content in connection with operating, improving, and marketing the Site and Services, unless you revoke permission in writing for future use.
Cre8tion may remove User Content at its discretion.
Client Content and Course Creation Responsibilities
“Client Content” includes all materials, information, data, recordings, claims, scripts, branding, testimonials, student information, and third-party materials provided by or on behalf of a client.
You acknowledge and agree that:
- You are solely responsible for the accuracy, legality, and compliance of all Client Content.
- You represent that you own or have secured all necessary rights, licenses, consents, and permissions for Cre8tion to use Client Content.
- Any claims you request to be included, including health, financial, income, performance, or outcome-based claims, are truthful, substantiated where required, and legally compliant.
- Testimonials, reviews, before-and-after content, and endorsements you provide are genuine and include clear and conspicuous disclosures of material connections where required.
- If your course involves regulated subject matter, you are responsible for required disclaimers and compliance with professional and consumer protection laws.
Cre8tion reserves the right to refuse, pause, or modify work that it reasonably believes presents legal, regulatory, reputational, or platform-policy risk.
Intellectual Property
All content, design elements, text, graphics, logos, templates, software, and materials on the Site are owned by Cre8tion or its licensors and are protected by intellectual property laws. Ownership and license rights in deliverables are governed by the applicable Order. Unless otherwise stated, Cre8tion retains ownership of its pre-existing materials, processes, templates, methodologies, and know-how. Any feedback or suggestions you provide may be used by Cre8tion without restriction or compensation.
Third-Party Services
The Site or Services may integrate with or link to third-party platforms, tools, or services. Cre8tion does not control and is not responsible for third-party services, their availability, security, or data practices. Your use of third-party services is governed by their respective terms and policies.
Payments, Subscriptions, and Refunds
If you purchase services through the Site:
- Pricing, payment terms, renewal terms, and refund policies are disclosed at checkout or in the applicable Order.
- You authorize Cre8tion and its payment processors to charge your selected payment method.
- All fees are exclusive of taxes unless stated otherwise.
- Chargebacks may not be used as a substitute for good-faith dispute resolution. In the event that you use chargebacks as a method to circumvent purchase terms and refund policies, the Company may pursue all legal action available to it, including pursuing charges for theft of services.
AI-Assisted Tools
Cre8tion may use automated or AI-assisted tools in connection with transcription, editing, drafting, or content production. You acknowledge that outputs are not guaranteed to be accurate, and you agree to use your own judgment in verifying accuracy. You remain responsible for verifying compliance and suitability prior to any use or publication. AI outputs are not a substitute for professional judgment.
Disclaimer of Warranties
THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRE8TION DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CRE8TION DOES NOT GUARANTEE RESULTS, REVENUE, SALES, AUDIENCE GROWTH, PLATFORM APPROVAL, OR COURSE PERFORMANCE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW CRE8TION WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES. CRE8TION’S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SITE OR SERVICES WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT PAID TO CRE8TION IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Indemnification
You agree to defend, indemnify, and hold harmless The Alliance Mastermind, LLC DBA CRE8TION and its members, managers, officers, employees, contractors, and agents from any claims, liabilities, damages, losses, and expenses arising from:
- Your use of the Site or Services
- Your Client Content or User Content
- Your products, services, claims, testimonials, or marketing representations
- Your violation of these Terms or applicable law

Termination
Cre8tion may suspend or terminate access to the Site or Services at any time for violations, suspected violations, or risk exposure. Provisions that by their nature should survive termination shall survive.
Dispute Resolution and Arbitration
Any dispute arising out of or relating to these Terms or the Site or Services shall first be subject to informal resolution. If not resolved, disputes shall be resolved by binding arbitration administered by AAA or JAMS in Maricopa County, Arizona. Claims may be brought only on an individual basis. Class actions and representative actions are waived.
Governing Law and Venue
These Terms are governed by the laws of the State of Arizona, without regard to conflict of laws principles. Any permitted court proceedings shall be brought in Maricopa County, Arizona.
Miscellaneous
- Entire Agreement. These Terms of Use, together with any applicable Order, statement of work, or other written agreement expressly incorporated by reference, constitute the entire agreement between you and The Alliance Mastermind, LLC, an Arizona limited liability company doing business as CRE8TION, regarding your access to and use of the Site and Services, and supersede all prior or contemporaneous agreements, communications, representations, or understandings, whether written or oral. No reliance is placed on any statement or representation not expressly set forth in these Terms or an applicable written agreement.
- Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
- No Waiver. The failure of Cre8tion to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Cre8tion to be effective.
- Assignment. You may not assign, transfer, or delegate these Terms, in whole or in part, whether by operation of law or otherwise, without the prior written consent of Cre8tion. Any attempted assignment in violation of this section is void. Cre8tion may assign these Terms freely, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of its assets.
- Force Majeure. Cre8tion shall not be liable for any delay or failure to perform its obligations under these Terms resulting from events beyond its reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, pandemics, epidemics, government orders or regulations, power or internet outages, failures of third-party platforms or service providers, or other circumstances not reasonably foreseeable or preventable. Performance shall be excused for the duration of the force majeure event.
